Public offer agreement

This document is an offer (public offer) from the individual entrepreneur Baigurzhin Shyngys (hereinafter the Administrator) to any person (hereinafter the User) to conclude a service agreement through the website https://shejire.valmaty.kz (hereinafter the Site) in accordance with paragraph 5 of Article 395 of the Civil Code of the Republic of Kazakhstan. Payment for the service is acceptance of the offer.
1. Subject of the agreement
1.1. The Administrator provides the User with a service of automatic design of a family tree (shezhire) from the data entered by the User, and delivers the result in digital form: viewing on the Site and files for download (PNG, PDF).
1.2. The design background is created by a neural network, and the book texts are composed by the neural network only from the User’s notes. The Administrator does not carry out genealogical research and does not verify the accuracy of the information entered by the User.
2. Ordering procedure
2.1. No registration is required. The User enters the names and information about the ancestors, chooses the format and design and sees a preview with a watermark free of charge.
2.2. After payment, within a few minutes the Site creates the background and texts and opens the files for download through a personal order link. The User saves this link independently.
2.3. The User may correct names, years, places, notes and design free of charge through the personal link and download the files again. The background can be redrawn by the neural network a limited number of times, which is stated on the order page.
2.4. The service is considered rendered when the files are opened to the User for download. Printing and delivery are not part of the service.
3. Price and payment
3.1. Prices are in tenge (₸, KZT), 100% prepayment after viewing the preview:
- Digital family tree: a phone image and an A4 PDF — 2,990 ₸;
- Poster A2 for printing: an A2 PDF file, a phone image and an A4 PDF — 4,990 ₸;
- Family book: an A4 PDF book, an A2 poster, a phone image and an A4 PDF — 9,990 ₸.
3.2. Payment is by bank card through the Robokassa payment service. Card details are entered on the side of the payment service, and the Administrator does not receive them.
4. Rights and obligations
4.1. The User enters only information that he or she has the right to use, and does not place in the notes and photos any material that violates the law or the rights of third parties.
4.2. The background is created by a neural network and may differ from expectations in details. This is not improper performance of the service if the design matches the chosen style.
4.3. The Administrator may change the terms of the offer. The new version applies to orders paid after its publication.
5. Refund
5.1. If after payment the files could not be created for technical reasons and we did not fix this within a reasonable time, the money is returned to the same card within 14 calendar days. Because the result is digital and created individually, no refund is made after the files have been opened.
5.2. For a refund, write to [email protected], stating the order code and the payment date.
6. Personal data
Data processing is described in the Privacy policy. By paying for the service, the User agrees to it.
7. Liability and disputes
The parties bear liability under the legislation of the Republic of Kazakhstan and are released from it in cases of force majeure, including failures of third-party services (hosting, payment systems, neural networks). Disputes are resolved by negotiation, claims are sent to the Administrator’s e-mail, and the response period is 30 business days. If no agreement is reached, the dispute is heard in court at the Administrator’s place of registration.
